These Terms & Conditions (“Terms”) govern your access to and use of seafoodpacker.com (the “Site”) and any inquiry, quote, order, or purchase of products from Seafood Packer Bangladesh (“we,” “us,” “our,” “the Company”), whether made through the Site, email, or WhatsApp.

By browsing the Site, submitting an inquiry, requesting a quote, or placing an order, you (“you,” “the Buyer”) agree to be bound by these Terms. If you do not agree, please do not use the Site or place an order with us.

Seafood Packer Bangladesh is an export business based in Dhaka, Bangladesh, specializing in Live Mud Crab (Scylla serrata), Soft Shell Crab, Dried Fish, Black Tiger and Vannamei shrimp, and related seafood products, sold to wholesale and commercial buyers internationally.

Our core products include live animals (mud crab) and perishable goods (soft shell crab, dried fish, shrimp, and other seafood). By ordering from us, you acknowledge and accept the inherent characteristics of these products:

• Live crab is a living animal and its condition can be affected by handling, transit time, temperature, and factors outside our control once it leaves our facility
• Weight, size, sex ratio, and fat/meat content of live crab are natural and will vary within the graded range agreed at order confirmation
• Frozen and dried products have defined shelf lives and must be stored and transported at the temperatures/conditions specified at the time of sale
• Minor variation in count, size, or packaging weight is standard practice in the seafood export trade and does not constitute a defect

Prices quoted via email, WhatsApp, or the Site are indicative and subject to change based on live market conditions, seasonal availability, and freight costs, unless we’ve confirmed a price in writing for a specific order.

• An order is only confirmed once we issue a written order confirmation or proforma invoice and, where applicable, receive the agreed deposit or payment
• Quantities are subject to seasonal catch and farm availability and may be adjusted with your agreement if full volume isn’t available at the time of packing

Orders will not be packed or shipped until the agreed payment terms have been met. We reserve the right to hold or cancel an order if payment is not received as agreed.

We handle export documentation and shipping arrangements from Bangladesh in line with the agreed Incoterm for your order. However:

• The Buyer is responsible for obtaining any import permits, licenses, phytosanitary/health certificates, or other approvals required by their own country to import live crab, seafood, or dried fish
• We are not responsible for delays, rejections, or costs arising from the Buyer’s failure to secure required import documentation or comply with destination-country regulations
• Estimated transit and delivery times are provided in good faith but are not guaranteed, as they depend on airlines, shipping lines, and customs authorities outside our control
• Any destination-country duties, taxes, or import fees are the responsibility of the Buyer unless otherwise agreed in writing

Risk and title in the goods pass to the Buyer in accordance with the Incoterm specified on the order confirmation (e.g. FOB, CIF, EXW). Unless otherwise agreed in writing, once goods are handed to the freight forwarder, airline, or shipping line for export, responsibility for their condition in transit shifts as defined by that Incoterm.

We grade, pack, and inspect all products before shipment to confirm they meet the agreed specification. Because our flagship products are live and perishable, quality claims are handled under the following process:

• The Buyer must inspect goods immediately upon arrival, before removing them from their original packaging where possible
• Any claim regarding mortality, quality, weight, or grading discrepancy must be reported to us within of arrival
• Claims must be supported by clear photo and/or video evidence taken immediately upon opening the shipment, along with the shipment/airway bill number
• Natural mortality within an industry-standard tolerance for live crab in transit () is not eligible for claim, as this is an inherent risk of live-animal transport
• Claims will not be accepted for damage or loss caused by delays or mishandling attributable to the carrier, customs authority, or the Buyer after risk has passed (see Section 7)

Valid claims will be resolved at our discretion by replacement, credit toward a future order, or partial refund for the affected portion of the shipment — we do not offer refunds for the full order value based on a partial quality issue.

Because live and perishable products are sourced and prepared to order, cancellations after an order has been confirmed and packing has begun may not be possible, or may be subject to a cancellation charge to cover sourcing and packing costs already incurred.

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to severe weather, natural disasters, port or customs disruptions, strikes, government action, or other force majeure events. In such cases, we will notify the Buyer as soon as reasonably possible and work in good faith toward a fair resolution (rescheduled shipment, partial fulfillment, or refund of unfulfilled amounts).

To the fullest extent permitted by applicable law, our total liability arising from any order shall not exceed the value of the specific order giving rise to the claim. We are not liable for indirect, incidental, or consequential losses, including loss of profit, loss of business, or reputational loss, arising from delays, quality issues, or any other matter connected to your order, except where such liability cannot be excluded by law.

Nothing in these Terms limits liability for fraud, gross negligence, or any other matter that cannot be limited or excluded under applicable law.

All content on this Site — including text, images, graphics, logos, and design — is owned by or licensed to Seafood Packer Bangladesh and is protected by applicable intellectual property law. You may not reproduce, distribute, or use our content for commercial purposes without our prior written consent.

You agree not to use the Site to:

• Submit false, misleading, or fraudulent inquiries or order information
• Attempt to gain unauthorized access to our systems or data
• Introduce viruses, malware, or other harmful code
• Scrape, copy, or misuse content or pricing information for a competing business

We reserve the right to refuse service, cancel an order, or restrict access to the Site for any party we reasonably believe has violated these Terms.

These Terms are governed by the laws of the People’s Republic of Bangladesh, without regard to conflict-of-law principles.

We encourage Buyers to first raise any dispute directly with us at the contact details in Section 15, so we can work toward a resolution in good faith before pursuing formal proceedings.

We may update these Terms from time to time to reflect changes in our business, products, or legal requirements. The version posted on this page at the time of your order applies to that order. We encourage you to review this page periodically.
